Fox News: Clinton Being Investigated by Two Different Divisions of FBI

Fox News: Clinton Being Investigated by Two Different Divisions of FBI

Last night, Bret Baier brought about a half-dozen scoops to the final days of this campaign. It's hard to rank them in terms of importance, but let's start with this one, about Hillary Clinton's private e-mail server.

We learned there is a confidence from these sources that her server had been hacked. And that it was a 99% accuracy that it had been hacked by at least five foreign intelligence agencies, and that things had been taken from that . . .

If that's the case, then there is absolutely no question that Hillary Clinton's private server harmed national security.

The FBI's investigation into the Clinton Foundation that has been going on for more than a year has now taken a "very high priority," separate sources with intimate knowledge of the probe tell Fox News.

FBI agents have interviewed and re-interviewed multiple people on the foundation case, which is looking into possible pay for play interaction between then-Secretary of State Hillary Clinton and the Clinton Foundation. The FBI's White Collar Crime Division is handling the investigation.

Even before the WikiLeaks dumps of alleged emails linked to the Clinton campaign, FBI agents had collected a great deal of evidence, law enforcement sources tell Fox News.

"There is an avalanche of new information coming in every day," one source told Fox News, who added some of the new information is coming from the WikiLeaks documents and new emails.

FBI agents are "actively and aggressively pursuing this case," and will be going back and interviewing the same people again, some for the third time, sources said.

That's regarding the Clinton Foundation and "pay for play," a.k.a. bribery. But the investigation into Clinton's server and the e-mails is being handled by another division of the FBI. From Baier's live report last night:

As a result of the limited immunity deals to top aides, including Cheryl Mills and Heather Samuelson, the Justice Department had tentatively agreed that the FBI would destroy those laptops after a narrow review. We are told definitively that has not happened. Those devices are currently in the FBI field office here in Washington, D.C. and are being exploited.

The source points out that any immunity deal is null and void if any subject lied at any point in the investigation.

Meantime, the classified e-mail investigation is being run by the National Security division of the FBI. They are currently combing through former Democratic Congressman Anthony Wiener's laptop and have found e-mails that they believe came from Hillary Clinton's server that appear to be new, as in not duplicates.

Whether they contain classified material or not is not yet known. It will likely be known soon. All of this just as we move inside one week until Election Day.

It was just five days ago that the defensive spin from ThinkProgress and other liberal groups was "all the e-mails might be duplicates." Oh, well.

Andrew McCarthy asks a tough question — although all of his questions are tough:

What we don't know, however, is: Why has the FBI only recently learned about a computer used by Ms. Abedin? Remember, Abedin is said to have cooperated in the Clinton e-mails investigation and sat for a lengthy interview with FBI agents. The agents asked her about her e-mail practices. Assuming they asked basic questions, as agents are trained to do, they would have methodically itemized the computers and e-mail accounts she used.

Does this explanation from Abedin make any sense at all?

Top Hillary Clinton aide Huma Abedin has told people she is unsure how her emails could have ended up on a device she viewed as her husband's computer, the seizure of which has reignited the Clinton email investigation, according to a person familiar with the investigation and civil litigation over the matter.

In a sworn deposition in June, Abedin said she "looked for all the devices that may have any of my State Department work on it and returned — returned — gave them to my attorneys for them to review for all relevant documents."

Baier's jarring conclusion: "Barring some obstruction in some way, they believe they will continue to likely an indictment." An indictment of whom? Abedin? Cheryl Mills? Hillary Clinton?

Hey, Democrats? It Might Be Time to Panic.

That old devil, Donald Trump. He might just get Republicans coming home in the key states after all.

The WBUR poll in New Hampshire:

A new WBUR poll of likely voters in New Hampshire finds that Republican Donald Trump and Democrat Hillary Clinton are now in a dead heat with just five days to go before Election Day.

The survey also finds Republican Sen. Kelly Ayotte leading her Democratic challenger, Gov. Maggie Hassan, by 6 points in one of the key races that could determine which party will control the U.S. Senate.

The poll is consistent with a number of surveys across the country that suggest the presidential race has tightened considerably.

In the last WBUR poll — just three weeks ago — Clinton led Trump by 3 percentage points in New Hampshire. This new poll (topline, crosstabs) now shows Trump in front, with a razor thin 1-point lead, well within the 4.4 percentage point margin of error.

"The race really couldn't be closer in New Hampshire at the moment," said Steve Koczela, president of the MassINC Polling Group, which conducts the WBUR survey.

New Hampshire was one of those states I figured Trump would lose badly, one where he had never led a poll. Now you have to consider it a toss-up, or close to one.

The University of Denver poll has Colorado tied, with Trump and Clinton at 39 percent each. That's actually less of a shift than people may think; the previous three polls had Clinton ahead by 1 to 3 points.

Yesterday's Hampton University poll has Trump ahead by 3 in Virginia, another state he never led in any survey. These polls could all be outliers. The Hampton poll didn't list Gary Johnson, Jill Stein, or Evan McMullin, all of whom are on the ballot in Virginia.

ADDENDA: As mentioned on this morning's Hugh Hewitt show, I voted absentee this year, and voted for Evan McMullin. Needless to say, I instantly got the typically calm and easygoing response from Trump fans you would expect. Hugh made the argument that because Clinton's actions with her private server are now so clearly harmful to national security that even a Never Trumper like me has to be rooting for his victory. (It's easier to root for her defeat than his victory.)

Hugh convincingly argued that there will be more opposition to Trump's unconstitutional instincts than to Hillary's. If both are likely to face criminal charges and an impeachment attempt against their abuses of power, Trump will face opposition that Hillary will not. In short, "You have to vote for the lesser Constitutional crisis."
